Dear Sir,

We would be able to provide you with iDirect service over NSS6 Satellite KU band for west Sudan region. KU is not recommended in South Sudan, we do operate there over AMC12 C band. for more information please contact me at amir@intouch-sd.com

Best Regards,
Amir Elshiekh

You may not deliver iDirect products or services based on the iDirect hub in Sudan.  iDirect resellers found importing equipment into certain proscribed countries (Sudan, Syria, Iran, Cuba, N. Korea) will breach their contracts.  The end customer could then find himself with no support and no service.

If you're an iDirect reseller, please read your contract.  If you are obtaining gear from another iDirect reseller, suggest that they read their contract and understand the risk they run of losing the contract.

Most western governments with sanctions give easment to the rule when used in support of such organizations as UN, UNICEF, WFP etc.

There is indeed a license exception that can be applied for from the US. Dept. of Commerce.  It is my understanding, based on discussions with a company that specializes in import/export restrictions, that such exceptions are only very rarely granted.

You can probably place equipment in a non-sanctioned embassy, as that is considered foreign land.

I suspect that some international organizations may also apply for and possibly be granted exceptions.

The purpose of my post was to warn people that there are certain laws and contractual issues that apply, and that they should proceed with care and make sure they obey the proper licensing procedures.  The vendors have no choice.  If you illegally import into a proscribed country they will cancel their contract with you or your provider if that can be determined - otherwise they would be in trouble with the authorities themselves.  At least speaking from experience with iDirect's export officers - they appear to take the laws very seriously.

Gary, if your customer is a non-commercial customer, please provide the details so that those who might like to respond will know if you have a viable opportunity worth pursuing.  Since a license exception will be mandatory in any event (if you use iDirect or other US technology), you might as well get started on that process.  Email me and I can give you a referral to company that specializes in assisting with this process(but they aren't cheap).

Personally I wouldn't waste my time working on quotes or system designs for a deal in Sudan, without knowing who the customer was, what their odds were of getting a license, and that the process was well under way, as it can be quite time consuming.

Gary, in a personal email you accused me of "making blanket statements that carry some truth but not all the truth."  I hope that this additional information helps.  There are a number of posts on the SatSig forum from people trying to bring US technology into Sudan, Iran and Syria in particular; and I make a point to comment on it so that nobody gets burned through lack of knowledge about the legal and contractual issues involved.  I certainly don't intend to mislead anyone.

If you are actively marketing iDirect in Sudan, as you appear to be, you should be concerned about your iDirect contract if you have one, or your provider should be concerned about their iDirect contract, as you may be treading on thin ice.  Otherwise, I believe you should clearly demonstrate that you have a qualified prospect for whom hardware and services may be provided legally.

I am familiar with the laws and getting exemptions.  I do not have customers.  And I am not seeking customers; not sure where you read that into any statements.   I believe that it would be more appropriate to give the exceptions with the warning.  Don't you?  That is the whole truth.

Gary, your post said:

"What sats/service providers are giving good coverage for south/western Sudan?  Looking for ku band, and iDirect compatable systems if possible."

Since this forum is used by people seeking to buy and sell satellite services, this looks like one of any number of requests for a quote.

You mentioned Sudan and iDirect in the same post.  It’s logical for a reasonable person to assume you are looking to buy or sell iDirect services and hardware into a proscribed country.  I know that many people are not aware of the restrictions.  I attempted to be helpful to you and to those who responded to you.  You chose to snub me without offering any additional information.

If you knew the laws and you know the exceptions, why not come right out and say that your request is legitimate because of ….xyz.   Wouldn't that be "the whole truth?"

You've still told us nothing about your particular requirement.  Since your post did not include "the whole truth," in essense you simply asked - 'who is willing to put their contractual relationship with iDirect at risk to illegally deliver services to Sudan?"

Dear Gary,

Yes, Pat Gannon is correct, you may face disconnection if the HUB found that you are located in Sudan, unless some process has been done before your activation if someone did it, then you will have your service through an American HUB, and Via American made hardware, this headache it is our job to clear it not the client, if you are somehow related to the UN then it will make it much easier, if not like I said it's our job, and deliver a 24x7x356 service with quality to you.

If you need further info regards to this issue please contact me at: Sales@netvsat.net

Best Regards
Ahmed Musa

Sir;
If you read my previous comments, I referred to organizations such as UN as well as other groups for which easements are given, as an exception to an earlier post by Pat's blanket statement of total ban.  That should indicate that I have some experiential knowledge.
